General conditions of sale
1. CONDITIONS OF PURCHASE
The products are intended exclusively for the buyer’s personal use, without any direct connection with the buyer’s professional activity.
2. PRODUCT / PRICE
A – PRODUCT
The products offered for sale on the site which may possibly be attached to it are those which appear on the site, on the day of consultation and within the limit of available stocks.
In the event of unavailability of a product, the customer is informed of this unavailability:
– either, when placing the order: a message is displayed indicating that the desired product is temporarily unavailable,
- either, following validation of the order and before delivery, by email.
BAIN DE MINUIT does not have a store outside of its website, its Facebook page “Bain de Minuit swim” and its Instagram page @baindeminuitswim. All products sold by BAIN DE MINUIT are listed on the company’s websites/webpages (hereinafter referred to as the “Products”).
BAIN DE MINUIT does not distribute a paper catalog.
B – PRICE
The amount of shipping costs is notified to the customer before validation of the order.
It is specified that any promotions granted in the form of discount vouchers are only valid for a single order and for a given validity period and cannot be combined with other discount offers.
BAIN DE MINUIT reserves the right to modify its prices at any time, but the products will be invoiced on the basis of the prices in effect at the time the order is registered, subject nevertheless to the availability of said products.
C – CUSTOMS DUTY
Any order placed on the site and delivered outside the European Union may be subject to possible taxes and customs duties that are imposed when the package reaches its destination. These possible taxes or customs duties related to the delivery of an item are the sole responsibility of the customer.
3. REGISTRATION AND VALIDATION OF THE ORDER
A – TERMS OF THE ORDER
The customer views the products offered for sale on the day of consultation of the site by browsing through the different product categories.
The customer can select the products of his choice by adding them to the basket and then click on his shopping basket to see the contents of his basket displayed on the screen. The basket contains all the elements of the order and in particular the total amount including transport costs, the nature of the products ordered and their quantity. If the customer wishes to choose other products, he can continue browsing the site, being assured that the products he has just selected are kept in his shopping basket.
The customer has the possibility, at any time during the order process – namely up until   the moment before payment – ​​to return to this order, complete it, modify it, cancel it, and this, as long as he has not definitively validated it.
Any order form signed with the validation click constitutes an irrevocable commitment by the customer which can only be challenged in the case strictly provided for in this contract in the article “Right of withdrawal”.
Once the product selection is complete, the customer can order them by validating the order. A new page will then open inviting the customer to:
– enter their username (email address) and password if the customer is already registered on the site;
– or accurately complete a personal data collection form by filling in the mandatory fields, in particular Name, First Name, Email Address, Billing Postal Address, Delivery Postal Address.
The customer agrees to complete the form made available to him in good faith. The customer acknowledges that the data he communicates to BAIN DE MINUIT and which are stored in BAIN DE MINUIT’s information systems are accurate and constitute proof of his identity.
After entering their contact details and delivery address, the customer is informed of the different delivery options and the amount of the shipping costs. The customer is then invited to select and validate their payment method.
The order summary is displayed on the same page and includes all the information relating to this order, including in particular the nature, quantity and price of the products, the total amount (including transport costs) of the order, the billing and delivery details, the delivery address and the billing address.
After having taken note of the status of his order, the customer will be invited:
– either check the box “I have read and accept the general conditions of sale” then click on the PAY MY ORDER button to definitively validate your order,
– or use the menu at the top of the screen to modify their basket and add or remove products.
The data recorded by BAIN DE MINUIT constitutes proof of all transactions between BAIN DE MINUIT and the customer.
B- CONFIRMATION OF THE ORDER
Once the order has been confirmed and payment validated, the customer has access to a printable and saveable summary of the order, including the order references.
An order confirmation email will be sent as soon as possible by BAIN DE MINUIT to the email address provided by the customer and will include the following information:
– the order reference recorded at the time the order was placed,
– the order summary (designation of the Product(s) ordered, quantity, size, price),
– the total amount of the order, all taxes included,
– shipping costs,
– confirmation of payment.
In the event of a payment incident, the customer undertakes to return the products received to BAIN DE MINUIT upon first request.
In order to protect BAIN DE MINUIT from abusive practices carried out by fraudsters, and in the event that BAIN DE MINUIT or the online payment service provider suspects the fraudulent nature of an order, they reserve the right to ask the buyer (prior to processing the order) for additional documents (in particular proof of address and debit in the buyer’s name, photocopy of the Buyer’s identity card, photocopy of the Buyer’s bank card) in order to verify that the order is not fraudulent.
In the absence of a response from the buyer within fifteen (15) days following the sending of the request by BAIN DE MINUIT or the online payment service provider, the order will be cancelled and BAIN DE MINUIT will proceed as soon as possible to reimburse it to the bank account debited when ordering.
C – PROOF OF ORDER
It is expressly agreed between BAIN DE MINUIT and the customer that emails will be authentic between the parties, as will the automatic recording systems used on the site, in particular with regard to the nature and date of the order.
The customer may access, where applicable in accordance with the rules of common law, the electronic contract concluded between the buyer and BAIN DE MINUIT. To do this, he/she should contact Customer Service, to which he/she will provide all the necessary information, in particular the order number and his/her contact details.

BAIN DE MINUIT reserves the right to refuse to make a delivery or to honor an order.

5. DELIVERY AND RECEIPT
We decline all responsibility for any extension of delivery times due to the carrier, in particular in the event of loss of products, bad weather or strike.
Please note that certain deliveries may be subject to customs tariffs and delays.
A – DELIVERY METHOD
Once the order is prepared, it will be sent to the postal address provided by the customer when ordering.
The products will be delivered according to the delivery method chosen by the customer.
B – DEADLINES
In the event of a data entry error, particularly of the delivery address resulting in a delay or impossibility of delivery, BAIN DE MINUIT cannot be held responsible. All costs related to the reshipment of products due to a data entry error by the customer will be borne by the latter.
Any delays on the part of the carrier do not entitle the customer to claim damages. In any event, the order will be executed within a maximum period of thirty (30) days from the day following the day on which the buyer validated his order, subject to full payment of the price and compliance with the conditions of purchase. In the event of non-delivery at the end of this period, the buyer will have the option to cancel his order.
C – DELAY IN DELIVERY
If the maximum delivery time of thirty (30) days is exceeded, the customer may exercise their right to cancel the order with BAIN DE MINUIT Customer Service.
Any delay in delivery must be reported as quickly as possible by the customer by email to Customer Service so that the latter can take the necessary measures with the carrier responsible.
D – RECEPTION
Each delivery is deemed to have been made as soon as the products are made available to the customer by the Carrier. The customer can track the delivery of their package with a tracking number by consulting the carrier’s website as well as in their personal customer area, and on the link provided in their order confirmation email.
It is the customer’s responsibility to immediately check the conformity and integrity of the products shipped upon receipt of the products. The customer agrees to send a letter of complaint by e-mail or by post to BAIN DE MINUIT to notify any damage or deficiency within 3 days following the date of delivery of the products.
Any anomaly/reservation identified at the time of delivery (in particular late delivery, missing or damaged product) must be reported fully and precisely by the customer on the receipt provided by the Carrier at the time the products are made available and/or confirmed by registered letter to the Carrier within three (3) days following receipt of the order.
Any such reservation must be notified in parallel and as soon as possible to the BAIN DE MINUIT Customer Service. A copy of the complaint addressed to the Carrier must be attached.
If 5 working days after the shipment of the package it is still not delivered, the customer can contact the post office closest to the place of delivery to obtain a tracking of the order. If the package cannot be located, the customer must then contact BAIN DE MINUIT via Customer Service.
6. RETURN PROCEDURE
A- RETURN TERMS
You have 21 days from the day of delivery to make a return request (while stocks last).
BAIN DE MINUIT does not refund any items. Items that are returned by the customer will receive a credit voucher valid for the purchase value of the product, excluding shipping/delivery costs. This credit voucher is valid for a maximum of 5 years from the date it is sent to the customer by email.
Please note that we do not accept returns on orders placed during promotional periods, sales or other commercial offers.
Products must be returned complete, with all accessories, unworn, unwashed, unaltered and with the protective strip for swimsuit bottoms or one-piece swimsuits, with their original label still attached.
We reserve the right to refuse returns that do not meet these conditions.
B – FORCE MAJEURE
The following are expressly considered to be cases of force majeure, in addition to those usually accepted by the case law of the French Courts and Tribunals:
– total or partial strikes, internal or external to the company, blocking of means of transport or supply for any reason whatsoever, governmental or legal restrictions, computer breakdowns, blocking of telecommunications including networks and in particular the Internet.
The occurrence of a case of force majeure will initially suspend, by operation of law, the execution of the order.
If, after a period of three (3) months, the parties note the persistence of the case of force majeure, the order will be automatically cancelled, unless otherwise agreed by both parties.
7. DATA PROTECTION ACT
In accordance with the Data Protection Act 78-17 of 6 January 1978, as amended, you have the right to object (art. 38), access (art. 39), rectify or delete (art. 40) data concerning you. You can exercise this right by contacting SAS LCB SISTERS.

8. COPYRIGHT
This site constitutes a work protected in France by the Intellectual Property Code, and abroad by international conventions in force on copyright. The violation of one of the copyrights of the work is an offense of counterfeiting punishable, under the terms of article L.335-2 of the Intellectual Property Code, by 2 years of imprisonment and a fine of €150,000.
