And any non-trading individual wishing to make a purchase via the website www.baindeminuitswim.com (hereinafter referred to as the “Customer” or the “Buyer”).
1. Purchase Conditions
Products are intended exclusively for the personal use of the buyer, with no direct connection to their professional activity.
2. Products and Prices
A. Products
The products offered for sale are those listed on the website on the day of consultation and within the limits of available stock.
In the event of a product being unavailable after the order has been placed, the customer will be informed by email as soon as possible. The order will be cancelled and the customer will be immediately refunded.
BAIN DE MINUIT does not have a physical store. All products sold by BAIN DE MINUIT are listed on the company’s website.
B. Prices
Product prices are indicated in euros, inclusive of all taxes (VAT included), excluding shipping costs. The shipping costs are notified to the customer before the order is confirmed.
Promotional discount vouchers are valid for a single order and for a given validity period only, and cannot be combined with other discount offers.
BAIN DE MINUIT reserves the right to modify its prices at any time, but products will be invoiced on the basis of the rates in force at the time the order is registered, subject to the availability of said products.
C. Customs Duties
Any order placed on the website and delivered outside the European Union may be subject to taxes and customs duties imposed when the parcel reaches its destination. Any such taxes or customs duties related to the delivery of an item are the sole responsibility of the customer.
3. Order Registration and Validation
A. Order Process
The customer can select products of their choice by adding them to the shopping cart. The cart summarises the order details (total amount including shipping costs, nature and quantity of products).
The customer may, at any time up to the moment of payment, review, modify, or cancel their order.
Any order validated by the payment click constitutes an order validation binding the customer, which can only be challenged in the cases provided for under the “Right of Withdrawal” article.
To validate their order, the customer must:

The customer undertakes to provide accurate information. Data recorded by BAIN DE MINUIT constitutes proof of all transactions.
B. Order Confirmation
An order confirmation email is sent by BAIN DE MINUIT as soon as possible. It summarises the order (products, prices, shipping costs, total amount).
To combat fraud, BAIN DE MINUIT reserves the right to request additional supporting documents from the buyer (proof of address, identity document) before processing the order. In the absence of a response within 15 days, the order will be cancelled and refunded.

BAIN DE MINUIT reserves the right to refuse to make a delivery or to honour an order from a consumer who has not fully or partially settled a previous order or with whom a payment dispute is in progress.
5. Delivery and Receipt
A. Delivery Methods and Timeframes
Products are shipped to the postal address provided by the customer. The order will be fulfilled within a maximum period of 30 days from the day following the validation of the order.
Pre-order items are indicated on their product page with an approximate dispatch date. For an order containing both in-stock and pre-order items, the entire order is dispatched in a single shipment.
If delivery is impossible due to an error in the address provided by the customer, the cost of re-shipment will be borne by the customer.
B. Delivery Delays
In the event of the maximum 30-day delivery period being exceeded, the customer may cancel their order and request a refund. Any delay must be reported to Customer Service (contact@baindeminuitswim.com).
C. Receipt and Transfer of Risk
The transfer of risk occurs at the moment the customer physically takes possession of the products.
It is the customer’s responsibility to check the condition of the parcel upon receipt. Any anomaly (damaged parcel, missing product) must be noted on the carrier’s receipt and notified to BAIN DE MINUIT Customer Service within 3 days of delivery.
6. Right of Withdrawal and Returns
In accordance with Article L. 221-18 of the Consumer Code, the customer has a period of 14 days from receipt of the products to exercise their right of withdrawal without having to justify their decision or pay any penalties, with the exception of return shipping costs which remain the customer’s responsibility.
For hygiene reasons (Article L. 221-28 of the Consumer Code), swimwear whose hygienic protection has been removed, damaged, or which shows signs of use cannot be taken back or exchanged. Products must be returned in their original condition and packaging, with their labels attached.
Refund terms: BAIN DE MINUIT will refund returned items (including standard initial delivery costs) using the same payment method as the one used for the initial transaction, within a maximum of 14 days following receipt of the returned products or proof of their dispatch. Note: Store credit cannot be imposed on the customer in the context of the legal right of withdrawal.
7. Legal Guarantees
All products supplied by the Seller benefit from the legal guarantee of conformity (Articles L. 217-4 and following of the Consumer Code) and the guarantee against hidden defects (Articles 1641 and following of the Civil Code).
Legal guarantee of conformity: The consumer has a period of two years from the delivery of the goods to act. They can choose between repairing or replacing the goods, subject to the cost conditions provided for by Article L. 217-9 of the Consumer Code. The consumer is exempt from providing proof of the existence of the lack of conformity during the 24 months following the delivery of the goods.
Guarantee against hidden defects: The consumer may decide to implement the guarantee against hidden defects of the item sold. In this case, they can choose between the resolution of the sale or a reduction of the sale price.

8. Force Majeure
BAIN DE MINUIT’s liability cannot be engaged in the event of non-performance or delay in the performance of any of its obligations under these T&Cs if this results from a case of force majeure (strikes, natural disasters, pandemics, transport or telecommunications blockages).
9. Personal Data (GDPR)
Personal data collected is processed by LCB SISTERS in compliance with the General Data Protection Regulation (GDPR). It is necessary for the management of orders and commercial relations.
In accordance with the regulations, the customer has the right to access, rectify, delete, object to, and port their data. This right may be exercised by writing to: contact@baindeminuitswim.com or by postal mail to the registered office.

10. Intellectual Property
All elements of the BAIN DE MINUIT website are and remain the intellectual and exclusive property of the company LCB SISTERS. No one is authorised to reproduce, exploit, redistribute, or use in any way whatsoever, even partially, any elements of the site whether software, visual, or audio.
11. Consumer Mediation
In the event of a dispute, the customer must first contact BAIN DE MINUIT Customer Service (contact@baindeminuitswim.com) to attempt to find an amicable solution. Before any referral to the mediator, the customer must send a written complaint to BAIN DE MINUIT Customer Service.
In accordance with the provisions of the Consumer Code on the amicable settlement of disputes, the customer has the right to have free recourse to the following mediation service:
